New York No-Fault Divorce Attorney
The New York legislature has recently passed a new law that allows no-fault divorce. In the past, in New York, you could only file for a divorce with allegations of fault such as adultery, abandonment, imprisonment, and/or cruel and inhumane treatment. The new law allows no-fault divorce if you and your spouse have had irreconcilable differences for at least six months.
Contested divorces are stressful, expensive and emotionally draining on you and your family. Because of this, at Khan & Yau, P.C., we often encourage our clients to consider an uncontested divorce. Our attorneys provide compassionate and experienced counsel on your particular situation. We will ensure that the dissolution of your marriage is completed with the least amount of emotional and financial stress. However, if an amicable dissolution is not possible, we will advocate for you in a contested action.
An uncontested divorce is possible if the parties agree on all financial and custodial aspects, including:
- Property division
- Spousal maintenance
- Custody
- Child support
We also handle family law matters not related to divorce, including the preparation of prenuptial and postnuptial agreements, as well as second-parent adoptions, same-sex adoptions and guardianship proceedings.
