Our Bankruptcy Practice
We handle all matters related to Chapter 7, Chapter 11 and Chapter 13 bankruptcies, preparing and submitting all the paperwork necessary to complete the process, and acting as your advocate in meetings or hearings with creditors, the bankruptcy trustee, or the bankruptcy court.
When you come to us to learn your options for consumer bankruptcy, we will take you through the "means test" established by the recent revisions to the bankruptcy laws, so that we can determine whether you qualify to file under the liquidation of debt under Chapter 7. If you do, we will carefully explain what debts can be permanently discharged and which cannot (such as student loan payments, child support arrearages, and some tax obligations), so that you can decide whether a Chapter 7 will provide the relief you need. We will also make certain that any exempt property, including principal residence, car and retirement assets, is excluded from any sale of assets that might occur.
If you don't qualify for a Chapter 7 filing or you prefer to repay your creditors, we can help you complete the steps necessary to reorganize your debt under Chapter 13, which allows you to enter into new agreements to repay your debt over 3 to 5 years. We will help you put together a plan of reorganization to submit to your creditors and will review all proposed repayment arrangements you receive, to make certain they are within your means.
