Adoption for both parents ensures that each parent gets the same rights as a biological parent, i.e. there is no legal distinction between an adoptive parent and a biological parent. If the relationship is not legal, the stepparent or relative has no automatic parental rights to the child, and will be unable to make medical or education decisions for the child.

Stepparent Adoption in New York

There are two steps for a stepparent adoption; first, the adopting parent must be willing to assume financial and legal responsibility for the child, and second, the biological parent has to consent to the adoption or have his or her rights terminated because of neglect, abuse or abandonment.

The adoptive parent will need to go through a home study, a criminal background check, and a drug and alcohol screening before the court will approve the adoption. In New York, a child over the age of 14 can challenge an adoption.
